Intermediary Platform Scope & Driver Custodial Framework
DropJet Technologies (Proprietorship) operates exclusively as a digital communications and technology matchmaking platform. This policy outlines statutory intermediary liability boundaries, independent driver partner legal responsibilities, vehicle insurance mandates, and formal claim escalation procedures.
1. Intermediary Technology Platform Status & Zero Platform Cargo Liability
In accordance with Section 79 of the Information Technology Act, 2000 (Safe Harbour Protection for Intermediaries):
- Pure Technology Intermediary: DropJet operates solely as an online technology platform connecting independent vehicle operators (“Driver Partners” or “Pilots”) with consignors/customers seeking intracity courier or cargo transportation. DropJet is NOT a common carrier, freight forwarder, goods transport agency (GTA), or insurer.
- Zero Cargo Value Liability: DropJet assumes zero out-of-pocket financial liability for the commercial value of lost, damaged, spoiled, pilfered, or stolen shipments. DropJet's maximum financial liability for any proven platform service deficiency is strictly capped at a 100% refund of the platform delivery fare paid for that specific booking.
- Driver Partner's Sole Physical Custody & Bailee Liability: The independent driver partner who accepts the dispatch order acts as an independent bailee with exclusive physical custody of the parcel from the moment of pickup until OTP-authenticated delivery. Any transit damage caused by rough handling, negligent driving, vehicle tipping, water seepage, pilferage, loss, or theft is the 100% sole personal, financial, and civil/criminal liability of the driver partner.
- Customer Independent Transit Insurance: Customers sending commercial merchandise or goods valued above ₹10,000 are strongly advised to obtain independent third-party Goods-in-Transit (Marine Cargo) insurance from an IRDAI-registered insurance company. DropJet does not underwrite, sell, or manage cargo insurance.
- Excluded Goods: Unpackaged fragile glassware, unsealed liquids, currency notes/coins, precious metals/jewellery, and contraband substances are strictly excluded from all platform assistance.
2. Declared Value Limits & Statutory E-Way Bill Mandate
For commercial shipments dispatched on 3-Wheeler Autos, Tata Ace, or pickup trucks:
- The sender must declare the accurate value of the consignment during booking.
- An official GST E-Way Bill is legally mandatory for any commercial cargo exceeding ₹50,000 in value under statutory Indian GST laws. Senders must furnish the valid E-Way Bill prior to dispatch.
- The driver partner carries the physical or digital E-Way Bill along with the goods during road transit. DropJet bears zero liability for tax penalties, vehicle seizure, or delays resulting from missing or inaccurate customer E-Way Bills.
3. Independent Driver Partner Status & Personal Safety Disclaimers
Driver partners registered on the DropJet platform operate strictly as independent contractors on a Principal-to-Principal (P2P) basis:
- No Platform-Provided GPA or Health Insurance: DropJet explicitly does NOT provide Group Personal Accident (GPA) insurance, medical hospitalization coverage, disability cover, life insurance, or statutory employee benefits (such as ESI, EPF, or gratuity). Each driver partner is solely responsible for purchasing and maintaining their own personal accident, life, and medical insurance policies at their own cost.
- No Roadside Breakdown or Towing Services: DropJet is a software matchmaking platform and does NOT provide vehicular roadside assistance, tire puncture repair, mechanical towing, fuel delivery, or vehicle maintenance. In the event of a breakdown, tire puncture, or mechanical failure, the driver partner must independently arrange repairs, recovery, or alternative arrangements at their own expense.
- Mandatory Helmet & Traffic Compliance: Two-wheeler pilots must wear an ISI-certified helmet, and truck drivers must wear seatbelts at all times while operating vehicles. Drivers are solely and personally responsible for compliance with all traffic rules, speed limits, and any traffic challans or police fines incurred during transit.
4. Vehicle Commercial Motor Insurance & Driver's Sole Third-Party Road Liability
In strict adherence to Section 146 of the Indian Motor Vehicles Act, 1988:
- Mandatory Commercial Third-Party Insurance: Every 2-wheeler, 3-wheeler auto, Tata Ace, and pickup truck registered on DropJet must possess an active, valid Commercial Third-Party Motor Insurance Policy issued by an IRDAI-approved insurance company.
- 100% Driver Liability for Road Collisions & Public Damages: The driver partner and their motor insurance provider bear 100% sole civil, legal, and financial liability for any road traffic accidents, collisions, pedestrian or passenger bodily injury, fatal casualties, or third-party public/private property damages arising during the operation of the vehicle. DropJet bears zero liability for vehicular accidents or third-party claims.
- Driver Document Compliance: Driver partners must upload valid, unexpired vehicle documents (RC, Insurance, Fitness, and PUC). DropJet verifies document validity and restricts dispatch access for vehicles with lapsed or expired motor insurance.
5. Goods Damage, Loss & Driver Accountability Procedure
Because physical custody of the package belongs exclusively to the independent driver partner, the procedure for investigating transit damage or loss is as follows:
1. Incident Reporting (Within 24 Hours)
Notify DropJet Operations within 24 hours of scheduled delivery by emailing support@dropjet.in with your Order ID (e.g., DJ-82914-LKO) and brief description.
2. Evidentiary Documentation
Submit clear unboxing photographs, package exterior condition photos, original commercial retail invoice, and recipient statement.
3. Digital Telemetry & Route Audit
DropJet audits trip GPS route telemetry, pickup/delivery OTP timestamps, and driver partner transit logs to verify timeline facts.
4. Platform Fare Reversal & Driver Legal Liability Protocol
DropJet reverses 100% of the platform convenience delivery fare. As the independent driver partner holds sole physical custody and legal liability for the cargo, DropJet immediately freezes the driver partner’s platform wallet/payouts and provides verified identity credentials (Aadhaar, DL, vehicle RC, live GPS logs) to law enforcement (Police) and the customer to facilitate criminal FIR / direct damage recovery against the driver partner.
